You cannot steal what does not exist. Take-Two called in-game currency a “publisher-created fiction”

Take-Two lawyers argue that the company is not obligated to refund players' money after shutting down its game servers

Take-Two and 2K Games responded to a November 2023 class action lawsuit accusing the companies of stealing money due to shutting down their game servers. The plaintiffs are outraged that they lost access to in-game currency that had been purchased with real money.

The companies' lawyers noted that virtual currency is not the property of players, and the terms of service include a clause stating that Take-Two and 2K Games simply grant players a limited license to use it and have the right to revoke it at any time.

“Virtual currency is a publisher-created fiction subject to the terms of service,” the lawyers say, asking the court to dismiss the case.
