Last year, Nintendo sued Jesse Kagein, known as Every Game Guru, who had been streaming at least 10 unreleased Nintendo Switch games since 2022. The process ended with the corporation's victory, although the potential compensation could have been much higher.
The streamer sent letters to Nintendo headquarters, boasting that "he has a thousand spare channels" and that he "can do this all day long." These statements turned out to be empty, and additional profiles did not save him when the company's lawyers stood in his way.
The streamer destroyed all evidence and avoided responsibility, which is why court notices were sent to his grandmother, mother, and partner, but remained unanswered. As a result, the Federal Court of Colorado issued a default judgment: Kagein was awarded $17,500 in compensation for copyright infringement.
Nintendo also demanded the destruction of "all circumvention devices," but the court rejected this request as "vague" and "unreasonable" due to the availability of emulators.
The company could have demanded up to $100,000, $10,000 for each game, but limited itself to $10,000 for the last violation and $7,500 for repeated circumvention.
