Such fan projects are considered "piracy."

Recently, the attention of fans of the cubic sandbox game Minecraft was drawn to a discussion around Stop Killing Games. Representatives of the movement published a fragment of the discussion.

It turned out that the Entertainment Software Association (ESA) believes that private Minecraft servers violate the law.

During the discussion, a member of the legislature mentioned "community servers" (private servers) for Call of Duty and Minecraft – in response, ESA Vice President for State Government Affairs Jennifer Gibbons called them "illegal."

Private servers, in her opinion, resemble a "black market" for video games, and the ESA considers them "piracy." She also noted that the association is currently pursuing several lawsuits against the owners of private servers.

It does not seem that Microsoft and Mojang Studios share the Entertainment Software Association's position on private Minecraft servers. Many fan projects have been operating and developing freely for many years.

However, the Entertainment Software Association represents many American development companies, including Microsoft. Representatives of the latter have not commented on the statement by the ESA Vice President.
